Manager, Workers Comp & Employee Absences

PURPOSE: Manage the Self-Insured Workers’ Compensation program for Lincoln Electric and provide oversight of all outside vendors that assist in the administration and litigation of open and new Workers’ Compensation claims.  Directly assist injured employees in establishing new Workers’ Compensation claims and/or assistance in reactivating and navigating the complexities of the system.  Makes ongoing decisions on the acceptance or denial of Workers' Compensation claims as well as addressing ongoing requests for compensation and medical treatment.  Assure that Lincoln Electric is compliant with all state Workers’ Compensation laws and rules; all Workers' Compensation claims reserves are SOX compliant and appropriately set to reflect current Workers’ Compensation liabilities.

 

JOB DESCRIPTION (DUTIES AND RESPONSIBLITIES):

  • Oversight and management of all existing open Workers' Compensation claims, developing strategies with outside legal counsel and Third Party Administrator to mitigate financial exposure. Determines the initial allowance or denial of new claims, requests for compensation and medical treatment.  Liaison between Third Party Administrator, Medical and EHS department in attaining reports utilized for metrics.  Review and provide data for absence management and benefits entitlements to HR and Employee Association. Review and submit yearly Medicare profile for reporting compliance.  Ongoing communication with Employee Relations Specialist to assist in mitigating legal exposure as it pertains to Workers' Compensation, ADA, and EEOC Laws.  Review and determine appropriate external vendors (Third Party Administrator, Investigators, Counsel, and Independent Medical Examiners) to attain best level of service to meet needs of internal and external customers.
  • Collaborate with the injured worker’s supervisor to perform investigations on all new alleged claims to verify mechanism of injury.  Coordinate with the medical department to obtain all relevant supporting medical evidence.  Analyze all medical and factual documentation from investigation to make a determination to either allow or deny the claim.  Meet with injured worker to either gather more factual information regarding the claim or explain basis for denial and the hearing process if claim denial decision is made.
  • Responsible for attending, participating and presenting evidence and testimony as Lincoln Electric’s authorized representative for Workers' Compensation matters at the Administrative (Industrial Commission) level up to the Court of Common Pleas.  The Workers' Compensation Administrator is responsible for justifying denial decisions on claims and also providing further insight and justification regarding medical management decisions and lost time compensation issues.
  • Ultimate responsibility and oversight for financial reserving of Workers' Compensation claims assuring that individual Workers' Compensation claims financial reserves are adequate to cover future exposure and that reserves are established complying with Lincoln Electric’s Internal Controls, compliant with the Excess Insurance Carrier’s requirements and are SOX compliant. For Workers' Compensation claims that have pierced excess retention level (deductible established by the excess carrier), the Workers' Compensation Administrator assures that the Third Party Administrator is filing for all monies that exceed excess retention in the specific claims and that requests are made and received on a quarterly basis so as to assure that Lincoln Electric is reimbursed timely. Prepare and pass internal audit and random external audits conducted by the Ohio Bureau of Workers' Compensation as well as with outside auditors such and Ernst and Young. Maintain and update any change in policies and procedures as so outlined by Internal Controls.
  • Responsible for providing comprehensive settlement analysis to Senior Management on claims where the settlement value will exceed $50,000.  (The Workers' Compensation Administrator's settlement authority is $50,000.00.) Works collaboratively with legal counsel and the Third Party Administrator regarding settlement demands and/or decision making concerning legal actions/defense of litigated claims. Please note that the number of claims analyzed for settlement varies from year to year based on claims involved in litigation or that are deemed necessary to settle or mitigate future financial exposure to Lincoln Electric.   
  • Attend Quarterly Self-Insured Bureau of Workers' Compensation workshops to remain compliant with any program changes as dictated by Ohio Bureau of Workers' Compensation. Participates in annual administrative and maintenance updates actively within local and state Self-Insured Associations keeping updated on industry trends, legal updates and rule changes.  Develop and present Workers' Compensation training to Supervisors and HR professionals in subsidiaries presenting updated legal and rule changes where applicable.
     

BASIC REQUIREMENTS:

  • 10 or more years’ experience in the direct management of Self Insured Workers' Compensation programs with a focus on direct claims management, hearing attendance, human resources and/or risk management. 
  • A four year Bachelor’s degree in business administration, insurance, medical and/or related field.
  • Prior experience in direct management of staff.
  • Must possess a high degree of integrity and dependability. 
  • Must have excellent verbal and written communication skills. 
  • Must be able to work with individuals at all levels of the company as well as externally. 
  • Discreetly handle confidential information. 
  • Must be able to analyze and manage cost of all programs. 
  • Solid comprehension of Bureau of Workers' Compensation rules and regulations as they pertain to Self-Insured employers.
  • Ability to diffuse explosive emotional situations with employees who may be difficult and irate.
  • Prior direct Claims Management and Industrial Commission hearing experience in Workers' Compensation matters is a plus.
  • Basic knowledge of MS Word, Excel, Power Point, Outlook, Lotus Notes, SAP and general knowledge of internet based computer programs.
